Indy man fights off would-be burglar with baseball bat; burglar found with meth, syringe

INDIANAPOLIS — An Indianapolis man has been charged with five felonies after recently released court documents say he broke into a man's east side house while in possession of meth.

Ramses Alberto Martinez, identified as Ramses Millan-Martinez in court documents, is charged with burglary resulting in bodily injury, burglary of a dwelling, residential breaking and entering, unlawful possession of a syringe and possession of methamphetamine, all felonies. He's also charged with misdemeanor battery.

According to court documents, around 3:10 a.m. on Tuesday, July 23, IMPD officers were dispatched to a reported burglary at a home on East New York Street. Officers were informed that the victim was still on the phone with the 911 dispatcher and was actively in a physical altercation with the suspect, later identified as Martinez.

When officers arrived at the scene, they found all the doors to the home locked. The victim told the 911 dispatcher that he was unable to come to the door because he was still fighting off Martinez. Officers forced their way in through the front door, and the victim flagged down their location to officers.

Court documents say officers were able to break up the altercation, put Martinez in handcuffs and escorted him from the home. Medics tended to Martinez, who suffered cuts to his arms during the altercation.

After being read his Miranda rights, Martinez allegedly told police that he did nothing wrong and did not know how he got inside the house due to the altercation. Police searched Martinez and allegedly found a syringe and a plastic bag with a gray-colored powdered substance inside. Martinez allegedly told police the substance was meth.

According to court documents, the victim allegedly told police that he was asleep when he was woken up by the sound of someone moving around inside his house. The victim became alarmed because he lives alone, so he grabbed a baseball bat that was beside his bed and began to investigate the noise. 

The victim then told police when he found Martinez, Martinez began yelling nonsense at him, so he struck him three times with the baseball bat. Court documents say the altercation went on for about five minutes before the victim was able to call police. The victim allegedly told police he did not know Martinez.

During the police investigation, officers found a plastic lawn chair that did not belong to the victim had been pushed up against the victim's privacy fence behind his house. The back door to the victim's house was found to be unlocked, according to court documents.

Later, IMPD officers were informed that Martinez had an active warrant in Marion County for illegal possession of a syringe, in addition to an active warrant out of Hancock County for driving while suspended.

 As of the publishing of this article, Martinez' initial court date has not yet been set.
