INDIANAPOLIS — An Indianapolis man has been charged after allegedly attacking an employee at an east side Arby's restaurant over a mobile order.
Augustus Harper has been charged with two felony counts of intimidation by drawing a deadly weapon, one felony count of pointing a firearm at another and a misdemeanor charge of battery.
According to recently released court documents, on Wednesday, May 29, IMPD officers were called to an Arby's restaurant in the 10800 block of East Washington Street, near German Church Road, on a report of a disturbance with a weapon.
When officers arrived, they spoke with an employee at the restaurant who told police that a customer, later identified as Harper, was upset that his mobile order was not complete when he arrived. The employee allegedly told police Harper became angry and aggressive when told his order was not yet ready.

The employee said while Harper was trying to enter the restaurant through the drive thru window, he punched the employee in the head, neck and shoulders before leaving in a black Chevrolet Equinox. The employee said Harper came back after "a short period of time" and approached the drive thru window on foot while carrying a handgun.
Court documents say the employee told police Harper pulled the handgun out of his waistband, cocked it and pointed it at them, threatening to shoot. The employee told police that as they went to secure the entryways with other employees, they saw Harper circle the restaurant in his car and on foot while waiving his handgun in the air.
According to court documents, the employee had a small laceration to his left hand and complained of pain in his hand and neck.

Police then spoke to the manager of the Arby's, as well as another employee who caught a small portion of the altercation on their smartphone. Both the manager and other employee corroborated the initial story and gave the same description of the suspect to police.
The manager of the Arby's turned the mobile order information over to police, who used the information to track down Harper. Harper was then identified as the suspect through a photo array.
According to online court records, Harper's initial hearing is scheduled for Friday, July 19 at 9 a.m.
