Fiancée of man killed outside Camby Walmart wants charges filed against person who shot him

Matthew Steele, fiancée of Tiffany Waller, was shot in the stomach after he confronted a man who was harassing them in the Walmart parking lot in Camby back in June.

INDIANAPOLIS — As Tiffany Waller scrolls through photos of her and her fiancé Matthew Steele, she couldn't help but get emotional when she sees his hazel eyes.

"It's been hell. I lost my home. I have his daughter; they're going through things. It's just been horrible," Waller said.

According to Waller, Steele was shot in the stomach after he confronted a 19-year-old man who was harassing them in the Walmart parking lot off West Mooresville Road and State Road 67 in Camby around 1:45 p.m. June 2.

Waller says the two started off yelling at each other until Steele punched the man in his face.

That's when Waller says the 19-year-old picked up a gun off his lap and shot her fiancé.

"I don't think you should be able to hit somebody and strike them one time and just use force and kill them," Waller said.

But the Hendricks County prosecutor said evidence proved differently.

Wednesday, the sheriff's office sent a statement saying the prosecutor has declined criminal charges against the 19-year-old.

13News' Chase Houle reached out to county prosecutor Loren Delp to see what evidence brought him to that conclusion, but never heard back.

Daniel Vaughn, a lawyer in Indianapolis, says it depends if a single punch could warrant a firearm being used. 

"In Indiana, the law says, if I believe that I'm trying to prevent a forcible felony against myself or another person, preventing serious bodily harm, then I can use a reasonable level of force, up to deadly force, so it can be allowed, yes," the sole practitioner of Daniel Vaughn Law explained.

Waller says she's not anti-gun at all but believes you should be at least 21 before you can buy a firearm.

"I think it would have gone way differently. If another grown adult and him would have gotten into it, they would have fought like grown men and not just shot," Waller said.

Houle also spoke to the Hendricks County Sheriff's Office and was told they won't comment on the prosecutor's decision not to press charges.

As for the investigation, the sheriff's office said they're still waiting for the final report.

Camby is a neighborhood in the southwest section of Indianapolis.
