Prosecutor: Greenfield officer's actions in excessive force complaint were not criminal

GREENFIELD, Ind. (WTHR) - The Hancock County prosecutor has decided allegations against a Greenfield police officer do not appear to be a criminal act.

The prosecutor's office said it reviewed the case against Greenfield Police Ofc. Justin Jackson, who was accused of using excessive force during an incident at Hancock Regional Hospital on August 23. Jackson and other officers reportedly responded to the hospital as part of an investigation into a female driver who was allegedly impaired.

Following the investigation, the woman was arrested and charged with battery on a public safety official, battery resulting in bodily injury, operating while intoxicated endangering a person, operating while intoxicated, resisting law enforcement and disorderly conduct.

The woman has pleaded not guilty to the charges against her.

Jackson was subsequently placed on administrative leave during a state police investigation into an altercation between the officer and the woman before she was taken to the Hancock County Jail. The results of the investigation were then passed on to the Hancock County Prosecutor's Office, which determined "there is not sufficient evidence that the altercation involving Officer Jackson resulted in criminal activity."

The prosecutor said it will be up to the mayor and police chief to determine "if the actions by Officer Jackson were appropriate and consistent with the standards the City of Greenfield has for law enforcement.

Jackson has been on leave since August 26.
