Indianapolis - The man convicted of killing Franklin student Kelly Eckart filed paperwork for a stay of execution which was scheduled for May 30th.

A jury found Michael Dean Overstreet guilty of killing Eckart in 1996. Eckart's mother expected Overstreet to file for a stay of execution, but Connie Sutton believes Overstreet must die for killing her daughter.

"He needs to die for what he did, because he doesn't need to be around anyone else to do it again because I don't think he'd have a problem doing it again," said Sutton.

The Indiana Attorney General's office says the appeals process will delay Overstreet's execution.

It could take three years or longer for the appeals process to play out.
