Operator of Circle Centre Mall Taco Bell sues to prevent Taco Bell Cantina location from opening nearby

In a lawsuit filed in the Marion County Superior Court, Alfarah Restaurant Group claims the Cantina location will "unfairly compete" with the existing location.

INDIANAPOLIS — The operators of the Taco Bell inside Circle Centre Mall want to stop a new Taco Bell Cantina location from opening this weekend in downtown Indianapolis.

In a lawsuit filed in the Marion County Superior Court, Alfarah Restaurant Group claims the Cantina location will "unfairly compete" with the existing location. 

The existing Taco Bell location is on the third floor of Circle Centre Mall. The Taco Bell Cantina location is slated to open to guests less than a quarter-mile away, at 24 W. Washington St., on Saturday, Dec. 23.

In addition to standard Taco Bell menu items, the Cantina location will have dual-level seating; designated dine-in, pickup and delivery areas; and specialty alcoholic beverages including beer, margaritas and liquor versions of Taco Bell's Freezes. 

In an email submitted by the plaintiffs in the lawsuit, Taco Bell corporate said it believes the two restaurants will not compete and will serve different clients.

The defendants will have until Jan. 22 to respond to the lawsuit.
