Court orders John Myers to stay in prison during appeal process

INDIANAPOLIS (WTHR) - The man convicted of killing Indiana University student Jill Behrman will remain in prison during his appeal.

Late Wednesday, the 7th Circuit Court of Appeals ruled that Myers should not be released from prison in the next few days. That overturns a decision by the federal district court in Indianapolis that agreed Myers should be let out.

His attorneys argued that Myers' medical situation made him especially vulnerable to COVID-19 while living in the group setting of a prison.

Myers is currently serving 65 years for Behrman's murder, which happened in 2003.

Myers appealed, claiming his attorney was ineffective and made a long list of mistakes. Last fall, a federal judge agreed and ordered he be retried or set free. The appeals of that decision are underway and Myers asked to be let out while the process continues.
