INDIANAPOLIS — Circle Centre Mall is seeking to evict Sugar Factory, claiming in a court filing that the restaurant has failed to pay more than $300,000 in rent.
In a lawsuit filed in Marion County Superior Court against SF Indianapolis 88, LLC in March, Circle Centre Mall LLC claims it declared the restaurant in default in January 2023 for failure to pay rent and failure to provide and install storefront identification that was required under the lease.
According to the filing, the mall terminated the lease on Jan. 31, 2024. Sugar Factory has continued to operate near South Illinois and West Maryland streets in downtown Indianapolis.
A copy of a letter sent to Sugar Factory included in the suit, dated Jan. 23, 2023, indicates it owed $333,778.96 in rent to the mall at that point.
According to online court records, Sugar Factory has not filed a response in court.
An eviction hearing is scheduled for 11:30 a.m. May 1.
The New York City-based restaurant, which serves a large menu including burgers, desserts and alcoholic beverages, opened a location in the mall in April 2022, replacing popular Italian restaurant Palomino.
