Suspects formally charged in pizza delivery driver's murder

Prosecutors filed formal charges Monday against the three men accused of murdering a pizza delivery driver.

INDIANAPOLIS (WTHR) – Prosecutors filed formal charges Monday against the three men accused of murdering a pizza delivery driver.

LaVon Drake was robbed, shot and killed a week ago while on the job.

All three suspects had their initial hearings Monday afternoon: 18-year-old Jason Epeards, 18-year-old Juwaun Terry and 19-year-old Jasean Dale.

Those suspects were silent while walking into criminal court.

They each face charges of murder and robbery resulting in serious bodily injury and they're being held in jail without bond.

A judge entered "not guilty" pleas on their behalf Monday.

They're accused of murdering LaVon Drake, a Papa John's delivery driver who was gunned down on the job.

According to the court's charging documents, this was a cold and calculated murder.

Drake was delivering a pizza to an east side house that turned out to be vacant.

Investigators say it was all a set up, that the three teenagers had no intention of paying for food, that they lured Drake inside with the motive of robbery.

Charging documents say the men forced Drake to the ground and shot him.

They took the pizza, took his money, then took his life.

Police say an alert neighbor noticed the license plate on the suspects' vehicle, which led detectives to the three suspects.

Drake's family didn't go to Monday's initial hearing.

At a vigil last week, his mother said, "The biggest thing, he never met someone he didn't love."

Police say they're still struggling with this sudden, violent loss.

Family of the three suspects did attend the hearing, but did not want to talk with Eyewitness News.

All three teenagers have trial dates set for October 29.
