Officers wound man who twice fired shots at officers during Muncie pursuit

A man wanted on two warrants led police on a low-speed chase, firing shots at officers on two occasions.

MUNCIE, Ind. — State police are investigating a shooting involving sheriff's deputies in Delaware County that left a suspect injured.

Muncie Police officers were initially called to investigate a man sitting in his car and drinking beer in a parking lot on Wheeling Avenue in Muncie. The man, identified as 38-year-old Benjamin Paul Brooks, refused to show his hands to the officers and told them he had a weapon. 

The suspect then drove slowly out of the parking lot, turning onto McGalliard Road, then north onto Walnut Street. Police say Delaware County deputies joined the low-speed pursuit and Brooks tried to ram officers' cars and fired a handgun out of his window toward officers. 

After one of the tires in the suspect's car was deflated by spike strips, he continued north, refusing to follow officers' commands.

Just after 10 p.m., police say Brooks got out of his car on CR 900 North east of Walnut and fired shots at officers, who returned fire and struck the man. The suspect got back in the vehicle and drove east, accelerating before eventually stopping on CR 900 North just east of CR 175 East.

Officers administered first aid while calling for medics. Brooks was taken to IU Health Ball Memorial Hospital in Muncie, but is condition is not known.

Investigators later learned Brooks was wanted on a Grant County warrant for possession of methamphetamine and a warrant out of Nevada for failure to appear for possession of a controlled substance.

The Delaware County Sheriff's Department asked Indiana State Police to conduct the investigation into the incident.
