Indianapolis man charged after allegedly hitting runner, 2 cars during Monumental Marathon

The incident happened Oct. 28 around 11 a.m. at 42nd Street and Clarendon Road.

INDIANAPOLIS — An Indianapolis man is facing charges after he allegedly hit a runner and two cars — one being an unmarked police car — during the CNO Financial Group Indianapolis Monumental Marathon.

Shortly before 11 a.m. on Oct. 28, IMPD officers responded to a report of a person struck and two vehicles struck.

A Clayton Police Department officer, who was directing traffic during the event, said a car was stopped at 42nd Street on the city's north side as runners competed in the race.

According to court documents, the Clayton officer said he noticed the driver, later identified as 19-year-old Joseph Kelly, of Indianapolis, growing impatient and inching forward. The officer said he tried to get Kelly's attention to stop by placing his hands on the hood of Kelly's car.

That's when the officer said Kelly sped up, drove past him and turned onto Clarendon Road, hitting a runner. Police said the runner did not stay at the scene.

Court documents say a detective at the scene said he saw Kelly hit a runner, so the detective said he tried to stop Kelly by putting his unmarked police car in the southbound lane of Clarendon Road.

According to court documents, Kelly hit the detective's car, as well as another car that was in the northbound lane of Clarendon Road, and drove off.

Court documents say an officer stopped Kelly four miles away at East 46th Street and Binford Boulevard. The officer placed Kelly in handcuffs.

Kelly said he fled from the scene because he was afraid due to an officer pointing a gun at him, according to court documents. 

Prosecutors charged Kelly with the following: 

  • Criminal recklessness with a deadly weapon
  • Resisting law enforcement
  • Two counts of failure to remain at the scene of an accident

Kelly had his initial court hearing Wednesday afternoon. A pretrial conference is scheduled for Nov. 29.
