Western Indiana man arrested for allegedly assaulting law enforcement during Jan. 6 Capitol riot

CARBON, Ind. — A western Indiana man was arrested Wednesday for allegedly assaulting law enforcement during the Jan. 6, 2021 attack on the U.S. Capitol, the FBI announced.

Nicholas Scott Ingram Hofer, 34, of Carbon, Indiana, "is charged in a criminal complaint filed in the District of Columbia with felony offenses of assaulting, resisting, or impeding certain officers and civil disorder," the FBI said in a statement.

Hofer is also charged with several misdemeanors, including:

  • Entering and remaining in restricted grounds or buildings
  • Disorderly and disruptive conduct in restricted grounds or buildings
  • Engaging in physical violence in restricted grounds or buildings
  • Disorderly conduct in a Capitol building or grounds
  • Committing an act of physical violence in the Capitol grounds or buildings

Hofer surrendered at the federal courthouse in Indianapolis Aug. 28 and will make an initial court appearance in the Southern District of Indiana, the FBI said.

"His alleged actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the 2020 presidential election," the bureau said.

According to court documents, Hofer was among rioters on the west plaza of the U.S. Capitol building and was later seen with rioters who breached a police line. He is alleged to have taken the following actions that day:

  • Surged up the stairs with other rioters, pushing them and a bike rack barricade into a police line
  • Entered the Capitol through a door broken by rioters
  • Threw a wooden exhibit stand inside the building
  • Knocked down a rioter in his path while attempting to re-enter the Capitol
  • Attempted with other rioters to breach another door at the Capitol
  • Worked with other rioters to take a riot shield from an officer
  • Pushed against a USCP officer, putting his hand on the officer's back and head
  • Refused to leave as officers worked to clear rioters
  • Spent a total of roughly 38 minutes inside the Capitol

The case is being investigated by the FBI with assistance from U.S. Capitol Police, the Metropolitan Police Department and U.S. Customs and Border Protection Services. It's being prosecuted by the U.S. Attorney's Office for the District of Columbia and the Department of Justice National Security Division's Counterterrorism Section.

Carbon is located in Clay County, Indiana, roughly 20 minutes northeast of Terre Haute.
