DELPHI, Ind. — The special judge in the Delphi murders case has canceled three days of hearings that were scheduled to take place this week in Carroll County.
On Monday, May 20, special judge Frances Gull canceled the hearings scheduled for May 21-23 in Carroll County, as well as the hearing on the motion to vacate safekeeping order.
Defense attorneys Brad Rozzi and Andrew Baldwin, who are representing Richard Allen, filed a second motion to disqualify Gull from the case on Friday, May 17.
Due to this 42-page filing, Gull said she must now review and make a decision on it, which requires her to cancel this week's hearings.
At a critical hearing May 7, Allen's trial was moved to Oct. 14 - Nov. 15, 2024. The trial had been scheduled from May 13 to May 31.
Allen's attorneys have also launched a new push to have him moved from a state prison to a county jail.
In new filings, Allen's attorneys are asking Gull to move Allen to either a Cass County or Tippecanoe County jail while he waits for his trial.
Allen was moved to the prison for safety reasons. Now, the sheriff has apparently made plans for Allen to stay in the Tippecanoe County facility during the October trial.
Also in new filings, the defense team asked for money to keep a third attorney on the case full-time.
There's no indications on when the judge will decide on either issue.
This week's hearings were going to address statements allegedly made by Allen regarding the murders, as well as a document filed May 6 by Carroll County Prosecutor Nicholas McLeland that he said incriminates Allen.
Rescheduled dates have not been determined at this time.
