LOGANSPORT, Ind. — Former Indianapolis Colts player Daniel Muir and his wife, Kristin, were in court Thursday, to challenge a judge's decision not to set bail for them.
The Cass County Superior Court judge declined to rule on the issue. The judge said the lawyers for the couple should have filed their appeal with the original judge, even though he was on vacation.
Daniel's attorney told the court, "this goes against hundreds of years of precedent" to deny bond in a case like this.
Kristin's attorney added, "We were not forum shopping," but filed in a court that had earlier availability to hear the petition for writ of habeas corpus.
The Muirs are both charged with obstruction of justice after a SWAT raid ended in their arrests. Daniel Muir is also charged with battery for allegedly beating his teenage son.
After their initial hearing, the Cass County Circuit judge declined to set bail — calling the Muirs a flight risk.

The Muirs' son was the subject of a Silver Alert after a report from his grandmother. She provided a photo that showed the boy with a black eye.
Police in Ohio stopped the Muirs' car, but police did not find the teen inside. According to court documents, the teen was found at the Muirs' home in Logansport.
Servant Leader's Foundation's connection:
Daniel and Kristin Muir were known members of the Servant Leader's Foundation.
While a simple search of the Servant Leader's Foundation won't lead to many results, a YouTube channel for the group can be found under the name of "StraitWay HelpMeets." In one of the pages most recent videos, Daniel Muir can be seen leading a service for the group.
He is featured in dozens of videos on the page where he is referred to as "Shepherd Pastor Muir," "Pastor Muir" and "Brother Daniel Muir."
According to the records, the group is the registered owner of the property that the Muir's were found in with "NO TRESPASSING" signs posted all over the area.
When entering the property, a large sign can be seen that reads "Welcome to Straitway Indiana Goshen."
Original Silver Alert issued June 25, 2024:
Indiana State Police is looking for a 14-year-old boy from Cass County, and a Silver Alert has now been issued for the teenager.
Bryson Muir was last seen June 16 with his mother when they were leaving his grandmother's house in the Cleveland, Ohio, area. His grandmother called the police and provided a photo with Bryson having a black eye as evidence of potential abuse. But when police pulled over the mother just a short time later in Garfield Heights, Ohio, Bryson was not in the vehicle.
The vehicle, reportedly a white 2015 Chevrolet Suburban, belongs to the Servant Leader's Foundation.
Muir described as being 6 feet 2 inches tall, 185 pounds and has black hair with brown eyes. He was last seen wearing an orange Under Armour shirt and blue jeans.
The boy is the alleged victim of domestic abuse, and his father is a former Indianapolis Colts player.
