Bartholomew County men charged with attacking officers during Jan. 6 Capitol riot

A Clark County, Indiana man pleaded guilty to assaulting officers during the riot.

WASHINGTON, D.C., USA — Two men from Bartholomew County have been arrested on felony and misdemeanor charges connected to the Jan. 6 Capitol breach. Those charges include assaulting law enforcement. 

Donald Lee Moss, 62, of Elizabethtown, and James Link Behymer, 61, of Hope, were arrested by the FBI on March 6, 2024.

The two are accused of shoving officers as the officers tried to keep a group of "violent rioters" from an entrance of the United States Capitol Building.

Moss can be heard on an officer's bodycam shouting, "This is our f—ing house!”

The two continued to push and assault officers, even pushing an officer from behind, according to the FBI.

Moss and Behymer were later caught on camera inside the Capitol, and Moss allegedly worked to keep a security door from being able to close by blocking it with a chair.

An Indiana militia member from southern Indiana was also arrested in connection to the Capitol riot. David Scott Kuntz, 53, of Elizabeth, is facing several felony charges.

From Clark County, Curtis Logan Tate, 32, of Jeffersonville, pleaded guilty to assaulting law enforcement during the Capitol breach. He faces sentencing in July.

Tate hit a police officer with a metal baton and posted video on social media in which he could be hear yelling, "We're tearing this motherf— down!”

Tate later entered the Capitol and repeatedly hit an officer in the head with a metal baton. He also helped pass weapons to other rioters to attack officers with. 

The FBI arrested Tate on Aug. 24, 2023.

According to the FBI, more than 1,358 people have been charged for crimes connected to the breach of the U.S. Capitol. About 480 of those are charged with assaulting or impeding law enforcement.
