How to find out if you're eligible for Apple settlement

The settlement stems from a class action lawsuit that alleges Apple slowed down some of its devices with an update.

INDIANAPOLIS — Apple is sending out settlement money to some of its customers.

Eligible customers will receive $92.17 via mail or direct deposit.

The settlement stems from a class action lawsuit that alleges Apple slowed down some its devices with an update.

Apple denies those allegations.

The settlement site says customers may get money if you are or were:

  1. A United States owner of an iPhone 6, 6 Plus, 6s, 6s Plus, 7, 7 Plus, and/or SE device,
  2. That ran iOS 10.2.1 or later or, in the case of iPhone 7 and 7 Plus devices, that ran iOS 11.2 or later before December 21, 2017, and
  3. You experienced diminished performance on your device(s).

Affected customers must also have filed a claim by the Oct. 6, 2020 deadline.

Customers who are unsure if they filed a claim in 2020 can search their email for a confirmation using the phrase "claim confirmation email."

13News consumer reporter Allison Gormly shared that while her claim had an old address on it, the settlement check went to her current address without mail forwarding.

What was Apple iPhone "batterygate" about?

In late 2017, Apple apologized for secretly slowing down older iPhones to avoid unexpected shutdowns related to battery fatigue.

According to the Associated Press, plaintiffs in the case claimed they spent hundreds of dollars buying new phones, rather than just replacing the batteries, because Apple didn't reveal the cause of the problem.

Attorneys claim it is the largest all-cash recovery in a computer intrusion case in history.

The settlement is not an admission of any wrongdoing by Apple, the lawsuit settlement website notes
